Retreat Agreement & Liability Waiver

RETREAT PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION

(“Agreement”)

Effective Date: Upon submission of application and/or payment of deposit or fees.

This Agreement is entered into by and between Leyline Travel, LLC (the “Company”), its founders, owners, managers, members, employees, contractors, agents, volunteers, guides, partners, successors, and assigns (collectively, the “Released Parties”), including Abby Lynn, and the undersigned participant (“Participant”).

By submitting an application, paying any deposit or fees, or participating in any journey, retreat, pilgrimage, event, orientation, or related activity (collectively, the “Program”), Participant acknowledges that they have read, understood, and agreed to all terms below.

1. Voluntary Participation

Participant voluntarily elects to participate in the Program. Participant understands that participation is optional and that they may withdraw at any time prior to travel subject to the Company’s refund and cancellation policies.

2. Nature of Activities

Participant understands that the Program may include, without limitation:

  • International travel and transportation by air, sea, and ground
  • Walking, hiking, standing for extended periods, uneven terrain, stairs, boats, ferries, and outdoor environments
  • Visits to ancient, historic, and remote sites with inherent risks
  • Exposure to weather, wildlife, altitude, and environmental conditions
  • Group activities, ceremonies, sound, meditation, breathwork, reflection, and educational experiences

Participant acknowledges that these activities involve inherent and unforeseeable risks.

3. No Medical or Psychological Services

Participant understands and agrees that Leyline Travel, LLC and Abby Lynn do not provide medical, psychological, psychiatric, or therapeutic services. Any spiritual, educational, or experiential offerings are not a substitute for professional medical or mental health care.

Participant represents that they are physically, mentally, and emotionally capable of participating, and that they have consulted a qualified professional if needed.

4. Assumption of Risk

Participant knowingly and voluntarily assumes all risks, known and unknown, foreseeable and unforeseeable, associated with participation in the Program, including but not limited to:

  • Physical injury, illness, or death
  • Emotional or psychological distress
  • Travel disruptions, delays, cancellations, or missed connections
  • Property loss, theft, or damage
  • Acts of God, weather events, pandemics, government actions
  • Actions or omissions of third parties, including vendors, transportation providers, lodging operators, and local guides

5. Release of Liability

To the fullest extent permitted by law, Participant waives, releases, and forever discharges the Released Parties from any and all claims, demands, actions, damages, losses, costs, or liabilities of any kind arising out of or related to participation in the Program, including claims based on negligence, except where prohibited by law.

6. Indemnification

Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from Participant’s actions, omissions, or breach of this Agreement.

7. Travel Insurance Requirement

Participant understands that travel insurance is required for all Programs and must include coverage for medical expenses, emergency evacuation, trip interruption, and cancellation. Failure to obtain adequate insurance does not relieve Participant of responsibility or risk.

8. Personal Responsibility & Conduct

Participant agrees to:

  • Follow all safety instructions and guidelines
  • Respect cultural norms, sacred sites, group boundaries, and other participants
  • Refrain from disruptive, unsafe, or unlawful behavior

The Company reserves the right to remove Participant from the Program without refund if Participant’s conduct is deemed unsafe or disruptive.

9. Photography & Media Release

Participant grants the Company permission to use photographs, audio, or video recordings taken during the Program for educational, marketing, or archival purposes, without compensation, unless Participant provides written opt-out prior to the Program.

10. Force Majeure

The Company shall not be liable for failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government restrictions, labor disputes, or transportation failures.

11. Refund & Cancellation Policy

Participant agrees to be bound by the Company’s Refund & Cancellation Policy, incorporated herein by reference and available here.

12. Governing Law & Venue

This Agreement shall be governed by the laws of the state in which Leyline Travel, LLC is organized, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the courts of that state.

13. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior communications or understandings.

15. Acknowledgment & Acceptance

By submitting an application, paying a deposit, or participating in the Program, Participant affirms that they:

  • Have read and understood this Agreement
  • Are legally competent to agree
  • Agree to be bound by its terms

Electronic acceptance constitutes a legally binding signature.
